The Service

THE WEARS ON is a cultural archive of fashion, music, and related editorial material. The Service may include Fits, Archive Fits, news, comments, lookbooks, member profiles, and Premium features.

Content is provided for editorial, archival, and informational purposes. Appearance of a brand, artist, designer, photographer, store, or other third party does not by itself mean sponsorship, endorsement, partnership, or official affiliation with THE WEARS ON.

We may change, suspend, or discontinue features of the Service, including Premium features, where reasonably necessary to operate, secure, or improve the Service.

Accounts

You may create an account with email and password, Sign in with Apple, or Google Sign-In, subject to the features available in the application.

You are responsible for the information you provide, for keeping your login details secure, and for activity on your account. You must not impersonate another person or use a username that you are not entitled to use.

We may freeze, restrict, or close an account where reasonably necessary to enforce these Terms, protect the Service or other users, or comply with law.

Premium Subscriptions

THE WEARS ON may offer a Premium auto-renewable subscription through the iOS application. Premium unlocks additional features described in the application at the time of purchase, which may include price and stock alerts, Archive Fits (THE VAULT), offline saved Fits, member titles, and related member tools.

3.1 Apple As Merchant Of Record

Premium subscriptions and related in-app payment transactions are processed by Apple through the App Store using StoreKit. Apple is the merchant of record for these purchases.

THE WEARS ON does not collect or store complete payment-card details. Payment, billing, tax, invoices, refunds, and payment-method changes are handled under Apple’s terms and policies.

The price, currency, billing period, free-trial terms, and any introductory offer shown in the App Store purchase sheet at the time of purchase are the terms that apply to that transaction.

3.2 Auto-Renewal

Payment is charged to your Apple ID account at confirmation of purchase.

The subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.

Your account will be charged for renewal within 24 hours prior to the end of the current period.

You can manage and cancel your subscriptions by going to your Apple ID account settings on the App Store after purchase.

3.3 Free Trial

Eligible users may receive a seven-day Premium trial, subject to Apple’s eligibility rules and the offer displayed at purchase. Unused trial time is forfeited when you purchase a subscription where Apple applies that rule. After the trial, the subscription converts to a paid auto-renewing period unless canceled in time through Apple.

3.4 Restore Purchases And Offer Codes

If you reinstall the application or sign in on another device, use Restore Purchases in the application so Apple can restore an active subscription associated with your Apple ID.

Subscription offer codes, where offered, are redeemed through Apple’s official redeem sheet in the application or through the App Store. THE WEARS ON does not grant Premium by entering a code into a custom field that bypasses Apple.

3.5 Account Freeze, Deactivation, And Cancellation

Freezing, deactivating, or deleting a THE WEARS ON account does not cancel an active Apple subscription and does not stop renewal charges.

To stop future charges you must cancel the subscription in your Apple ID subscription settings. Account deletion and subscription cancellation are separate processes.

Refunds, billing adjustments, and tax treatment are subject to Apple’s applicable policies.

User Content

You may post comments and other material permitted by the Service. You retain any rights you have in that material. You grant THE WEARS ON a non-exclusive, worldwide, royalty-free license to host, display, and distribute that material as needed to operate the Service.

You are responsible for your content. Do not post unlawful, infringing, deceptive, or abusive material, or content that violates another person’s rights.

We may remove content or restrict features where reasonably necessary to enforce these Terms or protect the Service.

Intellectual Property

THE WEARS ON, RACKSGRID, the application, the website, and the associated design system are owned by us or our licensors. These Terms do not transfer ownership of that material to you.

Photographs, product images, brand names, trademarks, logos, and similar material belonging to third parties may appear for editorial, archival, informational, or fashion-related purposes. THE WEARS ON does not claim ownership of third-party intellectual property unless explicitly stated.

Acceptable Use

You agree not to:

• Interfere with or disrupt the Service
• Attempt unauthorized access to accounts, systems, or data
• Scrape, harvest, or systematically extract content except as expressly permitted
• Misrepresent your identity or affiliation
• Use the Service to infringe intellectual-property or privacy rights
• Circumvent Premium access, Restore Purchases, or Apple’s payment systems

Third-Party Services And Links

The Service may link to stores, social platforms, or other third-party sites. Those destinations have their own terms and privacy practices. THE WEARS ON is not responsible for third-party sites, products, availability, or prices.

Authentication, infrastructure, and payments may involve Apple, Google, Supabase, Cloudflare, and other providers described in the Privacy Policy.

Disclaimers

The Service is provided on an “as is” and “as available” basis. Editorial material, Fit information, product details, stock, and prices may be incomplete, delayed, or incorrect. THE WEARS ON does not guarantee that a listed item is available, authentic, or offered at a particular price by a third-party store.

To the fullest extent permitted by law, we disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Limitation Of Liability

To the fullest extent permitted by applicable law, THE WEARS ON and RACKSGRID are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising out of your use of the Service.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

For Premium purchases processed by Apple, Apple’s terms also apply to payment and refund questions.

Changes

We may update these Terms from time to time. The “Last Updated” date indicates when they were most recently revised. Continued use of the Service after an update constitutes acceptance of the revised Terms, except where applicable law requires additional notice or consent.

If a change to these Terms is material, we may provide additional notice where required by law.
